With reference to your letter dated _________ requesting for issue of a "No Objection Certificate", it may please be noted that it is not our usual practice to issue such certificates. However, we have no objection to your applying for/renewing the Indian Passport, subject to the following conditions.

ANNEXURE - I

 

  1. Refusal of passports, travel documents, etc.

(2) Subject to the other provisions of this Act, the passport authority shall refuse to issue a passport or travel document for visiting any foreign country under clause (c) of sub-section (2) of section 5 on any one or more of the following grounds, and on no other ground, namely:-

(a) that the applicant is not a citizen of India;

(b) that the applicant may, or is likely to, engage outside India in activities prejudicial to the sovereignty and integrity of India;

(c) that the departure of the applicant from India may, or is likely to, be detrimental to the security of India;

(d) that the presence of the applicant outside India may, or is likely to, prejudice the friendly relations of India with any foreign country;

(e) that the applicant has, at any time during the period of five years immediately preceding the date of his application, been convicted by a court in India for any offence involving moral turpitude and sentenced in respect thereof to imprisonment for not less than two years;

(f) that proceedings in respect of an offence alleged to have been committed by the applicant are pending before a criminal court in India;

(g) that a warrant or summons for the appearance, or a warrant for the arrest, of the applicant has been issued by a court under any law for the time being in force or that an order prohibiting the departure from India of the applicant has been made by any such court;

(h) that the applicant has been repatriated and has not reimbursed the expenditure incurred in connection with such repatriation;

(i) that in the opinion of the Central Government the issue of a passport or travel document to the applicant will not be in the public interest.

AFFIDAVIT TO BE OBTAINED WHILE ISSUING IDENTITY CERTIFICATE FOR PASSPORT

  1. I am at present working at State Bank of Travancore, ……………Branch/Department,…………………….District, …………….... State, and is a citizen of India.

  2. I have not done nor will I do any activity, which would be prejudicial to the sovereignty and integrity of India. I am not a member of any organization notified as unlawful / terrorist organization nor in receipt of any fund from such organization.

  3. My departure from India would not in any way be detrimental to the security of India nor my presence in any country outside India shall prejudice the friendly relations of India with any foreign country.

  4. I have not been convicted by any court of India for any offence, including an offence, which involves moral turpitude.

  5. No criminal proceedings in respect of an offence alleged to have been committed by me are pending against me before any court in India.

  6. To the best of my knowledge, no warrant or summons for my appearance, or a warrant for my arrest has been issued by any court in India under any law nor has any order prohibiting my departure from India been issued or made by any court.

  7. There has been no occasion when I had to be repatriated to India and the expenditure incurred in connection with such repatriation not being re-imbursed by me.

  8. To the best of my knowledge and thinking there are no circumstances or grounds, which would persuade the Central Government to form an opinion, that issue of passport or travel document to me would not be in public interest.

  9. I have read and understood Section 6(2) of the Passport Act 1967 and none of the grounds stated therein for refusing to issue passport are attracted in my case.

  10. The above declarations are being made by me as, I intend to make an application for passport and have in this connection requested the Bank to give to me a Identity Certificate, as required to be furnished as per Column No 13 of the Passport Application Form.

  11. I am aware that the authorised officer of the Bank will rely upon my affidavit for issuing the Identity Certificate and appropriate civil / criminal proceedings can be initiated against me if the above declarations / representations made by me hereinabove turn out to be incorrect or false or misleading.

All the facts stated above are true to the best of my belief and information.
